Acceptable Use Policy

This policy specifies prohibited actions, and outlines acceptable uses of the Internet services we provide.

INTRODUCTION

This Acceptable Use Policy (AUP) specifies the actions prohibited by LIQUID PURPLE, located at 23921 Lake Dr #3474, Crestline, CA 92325-7679, USA, and outlines the acceptable use of Internet services, including web hosting, email, and digital services provided by LIQUID PURPLE and its affiliates. LIQUID PURPLE reserves the right to modify this Policy at any time, effective upon posting of the modified Policy to this domain: http://www.LIQUIDPURPLE.com/.

Violations of this AUP may result in LIQUID PURPLE taking actions, including, but not limited to, temporary or permanent removal of content, suspension, or termination of all or a portion of the Customer's Services, without notice. INDIRECT OR ATTEMPTED VIOLATIONS OF THIS POLICY, AS WELL AS ACTUAL OR ATTEMPTED VIOLATIONS BY A THIRD PARTY ON BEHALF OF A CUSTOMER OR A CUSTOMER'S END USER, SHALL BE CONSIDERED VIOLATIONS OF THE POLICY BY SUCH CUSTOMER OR END USER.

GENERAL USE

LIQUID PURPLE's networks and services, including web hosting, email, and digital services (e.g., SEO, web development, digital marketing), may be used only for lawful purposes. Transmission, distribution, or storage of any material in violation of applicable laws or regulations is prohibited, including material protected by copyright, trademark, trade secret, or other intellectual property rights used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.

Customer shall comply with all applicable laws and regulations of the United States and other governmental entities governing the use, distribution, exporting, or importing of data, technical data, and/or services, including data privacy laws such as GDPR and CCPA where applicable.

Customers must adhere to the bandwidth, data storage, and other limitations specified for the services purchased. Consistent use in excess of these limits may require upgrading to a higher service tier or payment for additional usage.

Customers shall not use LIQUID PURPLE's servers for development or debugging of applications or websites. Development should occur on the Customer's own systems before uploading to the LIQUID PURPLE network.

SYSTEM AND NETWORK SECURITY

Violations of system or network security are prohibited and may result in criminal and civil liability. While LIQUID PURPLE has no obligation to monitor services or network transmissions, LIQUID PURPLE reserves the right to monitor such services and transmissions from time to time and will investigate incidents involving violations.

Examples of system or network security violations include, without limitation, the following:

  • Unauthorized access to, or use of, data, systems, or networks, including any attempt to probe, scan, or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network.
  • Unauthorized monitoring of data or traffic on any network or system without express authorization of the owner of the system or network.
  • Interference with service to any user, host, or network, including, without limitation, mail bombing, flooding, deliberate attempts to overload a system, or broadcast attacks.
  • Forging of any TCP/IP packet header or any part of the header information in an email or digital transmission.

EMAIL

Sending unsolicited commercial email messages ("spam"), including, without limitation, commercial advertising and informational announcements, is prohibited in violation of the CAN-SPAM Act or other applicable laws. Unsolicited messages do NOT have to be sent through a LIQUID PURPLE mail relay to violate this AUP.

A user shall not use another site's mail server to relay mail without the express permission of that site.

HOSTING

The customer of any server or site hosted on LIQUID PURPLE's network is solely responsible for the content of their site, as well as the security of any applications and data stored thereon, and must obtain all required legal permissions for use of such content. Customers must ensure their content complies with applicable data privacy laws, including GDPR and CCPA where applicable. LIQUID PURPLE reserves the right to refuse to post, or to remove any information or materials, in whole or in part, that, in its sole discretion, it deems to be offensive, indecent, or otherwise inappropriate, regardless of whether such material or its dissemination is unlawful.
